purpose; membership; terms; compensation and expenses</catch_line><url>/30-359/</url></unit><unit id="765694"><section_number>30-360</section_number><catch_line>(Effective October 1, 2016) Review of plans to add a major intercollegiate athletics program or change the division level of an existing intercollegiate athletics program</catch_line><url>/30-360/</url></unit><unit id="776014"><section_number>30-360</section_number><catch_line>(Effective until October 1, 2016) Review of plans to add a major intercollegiate athletics program or change the division level of an existing intercollegiate athletics program</catch_line><url>/30-360/</url></unit></refers_to><url>/23.1-1309/</url><token>23.1/IV/13/23.1-1309</token><referred_to_by><reference>30-359</reference><reference>30-360</reference></referred_to_by><text><section id="2531005" prefix="A"><text/><type>section</type><prefixes><section>A</section></prefixes><entire_prefix>A</entire_prefix><prefix_anchor>A</prefix_anchor><level>1</level></section><section id="2531006" prefix="B"><text>The Auditor of Public Accounts, in collaboration with the Council, State Comptroller, Department of Planning and Budget, and each institution, shall develop and implement a standardized reporting format for each institution to annually report its intercollegiate athletics revenue and expenses to the Auditor of Public Accounts that shall include treatment of student fees and classification of specific intercollegiate athletics programs and shall require expenses for spirit groups, indirect cost policy requirements, and debt service for previously approved intercollegiate athletics capital outlay projects and other intercollegiate athletics capital outlay projects to be reported on separate lines.</text><type>section</type><prefixes><section>B</section></prefixes><entire_prefix>B</entire_prefix><prefix_anchor>B</prefix_anchor><level>1</level></section><section id="2531007" prefix="C"><text>The subsidy percentage shall not exceed:</text><type>section</type><prefixes><section>C</section></prefixes><entire_prefix>C</entire_prefix><prefix_anchor>C</prefix_anchor><level>1</level></section><section id="2531008" prefix="1"><text> 20 percent for NCAA Division I-A institutions affiliated with the Atlantic Coast Conference, Big Ten Conference, Big 12 Conference, Pac-12 Conference, or Southeastern Conference;</text><type>section</type><prefixes><section>C</section><section>1</section></prefixes><entire_prefix>C1</entire_prefix><prefix_anchor>C1</prefix_anchor><level>2</level></section><section id="2531009" prefix="2"><text> 55 percent for NCAA Division I-A institutions affiliated with conferences other than the Atlantic Coast Conference, Big Ten Conference, Big 12 Conference, Pac-12 Conference, or Southeastern Conference;</text><type>section</type><prefixes><section>C</section><section>2</section></prefixes><entire_prefix>C2</entire_prefix><prefix_anchor>C2</prefix_anchor><level>2</level></section><section id="2531010" prefix="3"><text> 70 percent for NCAA Division I-AA institutions;</text><type>section</type><prefixes><section>C</section><section>3</section></prefixes><entire_prefix>C3</entire_prefix><prefix_anchor>C3</prefix_anchor><level>2</level></section><section id="2531011" prefix="4"><text> 78 percent for NCAA Division I-AAA institutions;</text><type>section</type><prefixes><section>C</section><section>4</section></prefixes><entire_prefix>C4</entire_prefix><prefix_anchor>C4</prefix_anchor><level>2</level></section><section id="2531012" prefix="5"><text> 81 percent for NCAA Division II institutions that operate intercollegiate football programs;</text><type>section</type><prefixes><section>C</section><section>5</section></prefixes><entire_prefix>C5</entire_prefix><prefix_anchor>C5</prefix_anchor><level>2</level></section><section id="2531013" prefix="6"><text> 85 percent for NCAA Division II institutions that do not operate intercollegiate football programs;</text><type>section</type><prefixes><section>C</section><section>6</section></prefixes><entire_prefix>C6</entire_prefix><prefix_anchor>C6</prefix_anchor><level>2</level></section><section id="2531014" prefix="7"><text> 89 percent for NCAA Division III institutions that operate intercollegiate football programs; and</text><type>section</type><prefixes><section>C</section><section>7</section></prefixes><entire_prefix>C7</entire_prefix><prefix_anchor>C7</prefix_anchor><level>2</level></section><section id="2531015" prefix="8"><text> 92 percent for NCAA Division III institutions that do not operate intercollegiate football programs.</text><type>section</type><prefixes><section>C</section><section>8</section></prefixes><entire_prefix>C8</entire_prefix><prefix_anchor>C8</prefix_anchor><level>2</level></section><section id="2531016" prefix="D"><text>Each fiscal year, any percentage increase in the subsidy at an institution that complies with subsection C shall be matched by a like percentage increase in generated revenue, except that each such institution shall utilize a rolling average of the change in generated revenue and student fees over the immediately preceding five years for the purposes of such calculation.</text><type>section</type><prefixes><section>D</section></prefixes><entire_prefix>D</entire_prefix><prefix_anchor>D</prefix_anchor><level>1</level></section><section id="2531017" prefix="E"><text>When necessary, each institution shall submit to the Governor and the General Assembly for approval a plan that reduces the subsidy in accordance with targets outlined in the plan over a five-year period until the subsidy percentage complies with the requirements of subsection C.</text><type>section</type><prefixes><section>E</section></prefixes><entire_prefix>E</entire_prefix><prefix_anchor>E</prefix_anchor><level>1</level></section><section id="2531018" prefix="F"><text/><type>section</type><prefixes><section>F</section></prefixes><entire_prefix>F</entire_prefix><prefix_anchor>F</prefix_anchor><level>1</level></section><section id="2531019" prefix="G"><text>Failure to meet the progress requirements of each plan approved pursuant to subsection E for one year, as determined by the Auditor of Public Accounts, shall result in such reduction of the financial and administrative operations authority granted to the institution pursuant to the Restructured Higher Education Financial and Administrative Operations Act (&#xA7; 23.1-1000 et seq.) as the Governor or General Assembly determines.</text><type>section</type><prefixes><section>G</section></prefixes><entire_prefix>G</entire_prefix><prefix_anchor>G</prefix_anchor><level>1</level></section><section id="2531020" prefix="H"><text>Failure to meet the progress requirements of each plan approved pursuant to subsection E for two consecutive years, as determined by the Auditor of Public Accounts, shall result in revocation of all financial and administrative operations authority granted to the institution pursuant to the Restructured Higher Education Financial and Administrative Operations Act (&#xA7;
