<law><law_id>782077</law_id><section_number>33.2-2701</section_number><site_title>Virginia Decoded</site_title><site_url>https://vacode.org</site_url><edition url="https://vacode.org/2016/" id="11" last_updated="2016-07-24" current="TRUE">2016</edition><structure><unit level="1" identifier="33.2" url="https://vacode.org/2016/33.2/">Highways And Other Surface Transportation Systems</unit><unit level="2" identifier="IV" url="https://vacode.org/2016/33.2/IV/">Local And Regional Transportation</unit><unit level="3" identifier="27" url="https://vacode.org/2016/33.2/IV/27/">Transportation District Within The City Of Charlottesville And The County Of Albemarle</unit></structure><catch_line>Creation of district</catch_line><history>2004, c. 966, &#xA7; 33.1-448; 2014, c. 805.</history><order_by/><metadata/><official_url>http://law.lis.virginia.gov/vacode/33.2-2701/</official_url><refers_to><unit id="793501"><section_number>33.2-2714</section_number><catch_line>Abolition of local transportation districts</catch_line><url>/33.2-2714/</url></unit></refers_to><url>/33.2-2701/</url><token>33.2/IV/27/33.2-2701</token><referred_to_by/><text><section id="2522368" prefix="A"><text/><type>section</type><prefixes><section>A</section></prefixes><entire_prefix>A</entire_prefix><prefix_anchor>A</prefix_anchor><level>1</level></section><section id="2522369" prefix="B"><text>The petition to the local governing bodies shall:</text><type>section</type><prefixes><section>B</section></prefixes><entire_prefix>B</entire_prefix><prefix_anchor>B</prefix_anchor><level>1</level></section><section id="2522370" prefix="1"><text> Set forth the name and describe the boundaries of the proposed district;</text><type>section</type><prefixes><section>B</section><section>1</section></prefixes><entire_prefix>B1</entire_prefix><prefix_anchor>B1</prefix_anchor><level>2</level></section><section id="2522371" prefix="2"><text> Describe the transportation improvements proposed within the district;</text><type>section</type><prefixes><section>B</section><section>2</section></prefixes><entire_prefix>B2</entire_prefix><prefix_anchor>B2</prefix_anchor><level>2</level></section><section id="2522372" prefix="3"><text> Propose a plan for providing such transportation improvements within the district and describe specific terms and conditions with respect to all commercial and industrial zoning classifications and uses, densities, and criteria related thereto that the petitioners request for the proposed district;</text><type>section</type><prefixes><section>B</section><section>3</section></prefixes><entire_prefix>B3</entire_prefix><prefix_anchor>B3</prefix_anchor><level>2</level></section><section id="2522373" prefix="4"><text> Describe the benefits that can be expected from the provision of such transportation improvements within the district; and</text><type>section</type><prefixes><section>B</section><section>4</section></prefixes><entire_prefix>B4</entire_prefix><prefix_anchor>B4</prefix_anchor><level>2</level></section><section id="2522374" prefix="5"><text> Request the local governing bodies to establish the proposed district for the purposes set forth in the petition.</text><type>section</type><prefixes><section>B</section><section>5</section></prefixes><entire_prefix>B5</entire_prefix><prefix_anchor>B5</prefix_anchor><level>2</level></section><section id="2522375" prefix="C"><text>Upon the filing of such a petition, each local governing body shall fix a day for a hearing on the question of whether the proposed district shall be created. The hearing shall consider whether the residents and owners of real property within the proposed district would benefit from the establishment of the proposed district. All interested persons who either reside in or own taxable real property within the proposed district shall have the right to appear and show cause why any property or properties should not be included in the proposed district. Such resolution shall be binding upon the local governing body with respect to the inclusion or exclusion of such properties within the proposed district. The petition shall comply with the provisions of this section with respect to minimum acreage or assessed valuation. Notice of the hearing shall be given by publication once a week for three consecutive weeks in a newspaper of general circulation within the locality.
