requirements; powers of the Board</catch_line><history>2012, c. 3.</history><order_by/><metadata/><court_decisions/><official_url>http://law.lis.virginia.gov/vacode/54.1-2957.16/</official_url><refers_to/><url>/54.1-2957.16/</url><token>54.1/III/29/4/54.1-2957.16</token><referred_to_by><reference>54.1-2957.17</reference></referred_to_by><text><section id="2494897" prefix="A"><text/><type>section</type><prefixes><section>A</section></prefixes><entire_prefix>A</entire_prefix><prefix_anchor>A</prefix_anchor><level>1</level></section><section id="2494898" prefix="B"><text>The Board shall establish criteria for licensure as a behavior analyst, which shall include, but not be limited to, the following:</text><type>section</type><prefixes><section>B</section></prefixes><entire_prefix>B</entire_prefix><prefix_anchor>B</prefix_anchor><level>1</level></section><section id="2494899" prefix="1"><text> Documentation that the applicant is currently certified as a Board Certified Behavior Analyst by the Behavior Analyst Certification Board or any other entity that is nationally accredited to certify practitioners of behavior analysis;</text><type>section</type><prefixes><section>B</section><section>1</section></prefixes><entire_prefix>B1</entire_prefix><prefix_anchor>B1</prefix_anchor><level>2</level></section><section id="2494900" prefix="2"><text> Documentation that the applicant conducts his professional practice in accordance with the Behavior Analyst Certification Board Guidelines for Responsible Conduct and Professional Ethical and Disciplinary Standards and any other accepted professional and ethical standards the Board deems necessary; and</text><type>section</type><prefixes><section>B</section><section>2</section></prefixes><entire_prefix>B2</entire_prefix><prefix_anchor>B2</prefix_anchor><level>2</level></section><section id="2494901" prefix="3"><text> Documentation that the applicant for licensure has not had his license or certification as a behavior analyst or as an assistant behavior analyst suspended or revoked and is not the subject of any disciplinary proceedings by the certifying board or in another jurisdiction.</text><type>section</type><prefixes><section>B</section><section>3</section></prefixes><entire_prefix>B3</entire_prefix><prefix_anchor>B3</prefix_anchor><level>2</level></section><section id="2494902" prefix="C"><text>The Board shall establish criteria for licensure as an assistant behavior analyst, which shall include, but not be limited to, the following:</text><type>section</type><prefixes><section>C</section></prefixes><entire_prefix>C</entire_prefix><prefix_anchor>C</prefix_anchor><level>1</level></section><section id="2494903" prefix="1"><text> Documentation that the applicant is currently certified as a Board Certified Assistant Behavior Analyst by the Behavior Analyst Certification Board or any other entity that is nationally accredited to certify practitioners of behavior analysis;</text><type>section</type><prefixes><section>C</section><section>1</section></prefixes><entire_prefix>C1</entire_prefix><prefix_anchor>C1</prefix_anchor><level>2</level></section><section id="2494904" prefix="2"><text> Documentation that the applicant conducts his professional practice in accordance with the Behavior Analyst Certification Board Guidelines for Responsible Conduct and Professional Ethical and Disciplinary Standards and any other accepted professional and ethical standards the Board deems necessary;</text><type>section</type><prefixes><section>C</section><section>2</section></prefixes><entire_prefix>C2</entire_prefix><prefix_anchor>C2</prefix_anchor><level>2</level></section><section id="2494905" prefix="3"><text> Documentation that the applicant for licensure has not had his license or certification as an assistant behavior analyst suspended or revoked and is not the subject of any disciplinary proceedings by the certifying board or in another jurisdiction; and</text><type>section</type><prefixes><section>C</section><section>3</section></prefixes><entire_prefix>C3</entire_prefix><prefix_anchor>C3</prefix_anchor><level>2</level></section><section id="2494906" prefix="4"><text/><type>section</type><prefixes><section>C</section><section>4</section></prefixes><entire_prefix>C4</entire_prefix><prefix_anchor>C4</prefix_anchor><level>2</level></section><section id="2494907" prefix="D"><text>The Board shall promulgate such regulations as may be necessary to implement the provisions of this chapter related to (i) application for and issuance of licenses to behavior analysts or assistant behavior analysts, (ii) requirements for licensure as a behavior analyst or an assistant behavior analyst, (iii) standards of practice for licensed behavior analysts or licensed assistant behavior analysts, (iv) requirements and procedures for the supervision of a licensed assistant behavior analyst by a licensed behavior analyst, and (v) requirements and procedures for supervision by licensed behavior analysts and licensed assistant behavior analysts of unlicensed individuals who assist in the provision of applied behavior analysis services.</text><type>section</type><prefixes><section>D</section></prefixes><entire_prefix>D</entire_prefix><prefix_anchor>D</prefix_anchor><level>1</level></section><section id="2494908" prefix="E"><text>The Board shall establish a fee, determined in accordance with methods used to establish fees for other health professionals licensed by the Board of Medicine, to be paid by all applicants for licensure as a behavior analyst or assistant behavior analyst.</text><type>section</type><prefixes><section>E</section></prefixes><entire_prefix>E</entire_prefix><prefix_anchor>E</prefix_anchor><level>1</level></section></text></law>
