<law><law_id>770852</law_id><section_number>6.2-429</section_number><site_title>Virginia Decoded</site_title><site_url>https://vacode.org</site_url><edition url="https://vacode.org/2016/" id="11" last_updated="2016-07-24" current="TRUE">2016</edition><structure><unit level="1" identifier="6.2" url="https://vacode.org/2016/6.2/">Financial Institutions And Services</unit><unit level="2" identifier="I" url="https://vacode.org/2016/6.2/I/">General Provisions</unit><unit level="3" identifier="4" url="https://vacode.org/2016/6.2/I/4/">Certain Lending Practices</unit><unit level="4" identifier="3" url="https://vacode.org/2016/6.2/I/4/3/">Credit Cards.</unit></structure><catch_line>Improper use of payment device numbers</catch_line><history>2002, c. 744, &#xA7; 11-33.2; 2004, c. 793; 2009, c. 373; 2010, c. 794.</history><order_by/><metadata><court_decisions/></metadata><court_decisions/><official_url>http://law.lis.virginia.gov/vacode/6.2-429/</official_url><refers_to/><url>/6.2-429/</url><token>6.2/I/4/3/6.2-429</token><referred_to_by/><text><section id="2484542" prefix="A"><text>No person that accepts payment devices for any purpose shall print on any receipt provided to the holder of the payment device (i) more than the last four digits of the payment device number or (ii) the expiration date.</text><type>section</type><prefixes><section>A</section></prefixes><entire_prefix>A</entire_prefix><prefix_anchor>A</prefix_anchor><level>1</level></section><section id="2484543" prefix="B"><text/><type>section</type><prefixes><section>B</section></prefixes><entire_prefix>B</entire_prefix><prefix_anchor>B</prefix_anchor><level>1</level></section><section id="2484544" prefix="C"><text>The provisions of this section shall apply to all cash registers or other machines or devices that electronically print receipts for payment device transactions that are placed in service on or after July 1, 2003.</text><type>section</type><prefixes><section>C</section></prefixes><entire_prefix>C</entire_prefix><prefix_anchor>C</prefix_anchor><level>1</level></section><section id="2484545" prefix="D"><text>For all cash registers or other machines or devices that electronically print receipts for payment device transactions in service prior to July 1, 2003, the provisions of this subsection shall not apply until July 1, 2005.</text><type>section</type><prefixes><section>D</section></prefixes><entire_prefix>D</entire_prefix><prefix_anchor>D</prefix_anchor><level>1</level></section><section id="2484546" prefix="E"><text>Any person violating this section (i) shall be liable to the payment device holder and the issuer for any damages or expenses, or both, including attorney fees, that the payment device holder incurs due to the use of the payment device without the permission of the payment device holder and (ii) may be compelled, in a proceeding instituted in any appropriate court by the attorney for the Commonwealth, to comply with this section by injunction, mandamus, or other appropriate remedy. Without limiting the remedies authorized by this section in a proceeding instituted by the attorney for the Commonwealth, any person failing, neglecting, or refusing to obey any injunction, mandamus, or other remedy obtained pursuant to this section, shall be subject, in the discretion of the court, to a civil penalty not to exceed $ 1,000 for each violation.</text><type>section</type><prefixes><section>E</section></prefixes><entire_prefix>E</entire_prefix><prefix_anchor>E</prefix_anchor><level>1</level></section></text></law>
