COSTS (§ 64.2-2309)

The costs attendant to the issuing of an order determining death or the
revocation of such order shall be paid out of the estate of the presumed
decedent. If the petition for the issuance or revocation of an order determining
death is not granted, the costs shall be paid by the petitioner.
