Examples of collection methods that alone or combined meet the convenience requirements of this section include:\n\n1\n\nA system by which the manufacturer or the manufacturer&#8217;s designee offers the consumer a system for returning computer equipment by mail at no charge to the consumer;\n\n2\n\nA system using a physical collection site that the manufacturer or the manufacturer&#8217;s designee operates and to which the consumer may return computer equipment; and\n\n3\n\nA system using collection events held by the manufacturer or the manufacturer&#8217;s designee at which the consumer may return computer equipment.\n\nD\n\nCollection services under this section may use existing collection and consolidation infrastructure for handling computer equipment and should encourage the inclusion of systems jointly managed by a group of manufacturers, electronic recyclers and repair shops, recyclers of other commodities, reuse organizations, not-for-profit corporations, retailers, recyclers, and other suitable operations. If a manufacturer or its designee offers a mail-back system as described in subdivision C 1, either individually, by working together with a group of manufacturers, or by working with others, it shall be deemed to meet the convenience requirements of this section.\n\nE\n\nThe recovery plan shall include information for the consumer on how and where to return the manufacturer&#8217;s computer equipment. The <span class=\"dictionary\">manufacturer<\/span>: <a id=\"paragraph-1289044\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/10.1-1425.29\/#E\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E1\" class=\"indent-1\"><p><span class=\"prefix-number\">1.<\/span> Shall include collection, recycling, and reuse information on the <span class=\"dictionary\">manufacturer<\/span>&#8217;s publicly accessible website; <a id=\"paragraph-1289045\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/10.1-1425.29\/#E1\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E2\" class=\"indent-1\"><p><span class=\"prefix-number\">2.<\/span> Shall provide collection, recycling, and reuse information to the <span class=\"dictionary\">Department<\/span>; and <a id=\"paragraph-1289046\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/10.1-1425.29\/#E2\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"E3\" class=\"indent-1\"><p><span class=\"prefix-number\">3.<\/span> May include collection, recycling, and reuse information in the packaging or in other <span class=\"dictionary\">materials<\/span> that accompany the <span class=\"dictionary\">manufacturer<\/span>&#8217;s <span class=\"dictionary\">computer equipment<\/span> when the equipment is sold. <a id=\"paragraph-1289047\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/10.1-1425.29\/#E3\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"F\"><p><span class=\"prefix-number\">F.<\/span> Information about collection, recycling, and reuse on a <span class=\"dictionary\">manufacturer<\/span>&#8217;s publicly accessible website does not constitute a determination by the <span class=\"dictionary\">Department<\/span> that the <span class=\"dictionary\">manufacturer<\/span>&#8217;s recovery plan or actual practices are in compliance with this article. <a id=\"paragraph-1289048\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/10.1-1425.29\/#F\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"G\"><p><span class=\"prefix-number\">G.<\/span> If more than one <span class=\"dictionary\">person<\/span> is a <span class=\"dictionary\">manufacturer<\/span> of a certain <span class=\"dictionary\">brand<\/span> of <span class=\"dictionary\">computer equipment<\/span> as defined by &#xA7; <a class=\"law\" title=\"Definitions\" href=\"\/10.1-1425.27\/\">10.1-1425.27<\/a>, any of those <span class=\"dictionary\">persons<\/span> may assume responsibility for and satisfy the obligations of a <span class=\"dictionary\">manufacturer<\/span> under this article for that <span class=\"dictionary\">brand<\/span>. If none of those <span class=\"dictionary\">persons<\/span> assumes responsibility or satisfies the obligations of a <span class=\"dictionary\">manufacturer<\/span> for the <span class=\"dictionary\">computer equipment<\/span> of that <span class=\"dictionary\">brand<\/span>, any of those <span class=\"dictionary\">persons<\/span> may be considered to be the responsible <span class=\"dictionary\">manufacturer<\/span> for purposes of this article. <a id=\"paragraph-1289049\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/10.1-1425.29\/#G\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t<section id=\"H\"><p><span class=\"prefix-number\">H.<\/span> The obligations under this article of a <span class=\"dictionary\">manufacturer<\/span> who manufactures or manufactured <span class=\"dictionary\">computer equipment<\/span>, or sells or sold <span class=\"dictionary\">computer equipment<\/span> manufactured by others, under a <span class=\"dictionary\">brand<\/span> that was previously used by a different <span class=\"dictionary\">person<\/span> in the manufacture of the <span class=\"dictionary\">computer equipment<\/span> extends to all <span class=\"dictionary\">computer equipment<\/span> bearing that <span class=\"dictionary\">brand<\/span> regardless of its date of manufacture. <a id=\"paragraph-1289050\" class=\"section-permalink\" href=\"https:\/\/vacode.org\/10.1-1425.29\/#H\"><i class=\"fa fa-link\"><\/i><\/a><\/p><\/section>","plain_text":"                                 CODE OF VIRGINIA\n\nMANUFACTURER RECOVERY PLAN (\u00a7 10.1-1425.29)\n\nA. Before a manufacturer may offer computer equipment for sale in the\nCommonwealth, the manufacturer shall:\n\n   1. Adopt and implement a recovery plan; and\n\n   2. Affix a permanent, readily visible label to the computer equipment with the\n   manufacturer&#8217;s brand.\n\nB. The recovery plan shall enable a consumer to recycle computer equipment\nwithout paying a separate fee at the time of recycling and shall include\nprovisions for:\n\n   1. The collection from a consumer of any computer equipment that has reached\n   the end of its useful life and is labeled with the manufacturer&#8217;s brand;\n   and\n\n   2. Recycling or reuse of computer equipment collected under subdivision 1.\n\nC. The collection of computer equipment provided under the recovery plan must be\nreasonably convenient and available to consumers in the Commonwealth and\ndesigned to meet the collection needs of consumers in the Commonwealth. Examples\nof collection methods that alone or combined meet the convenience requirements\nof this section include:\n\n   1. A system by which the manufacturer or the manufacturer&#8217;s designee\n   offers the consumer a system for returning computer equipment by mail at no\n   charge to the consumer;\n\n   2. A system using a physical collection site that the manufacturer or the\n   manufacturer&#8217;s designee operates and to which the consumer may return\n   computer equipment; and\n\n   3. A system using collection events held by the manufacturer or the\n   manufacturer&#8217;s designee at which the consumer may return computer\n   equipment.\n\nD. Collection services under this section may use existing collection and\nconsolidation infrastructure for handling computer equipment and should\nencourage the inclusion of systems jointly managed by a group of manufacturers,\nelectronic recyclers and repair shops, recyclers of other commodities, reuse\norganizations, not-for-profit corporations, retailers, recyclers, and other\nsuitable operations. If a manufacturer or its designee offers a mail-back system\nas described in subdivision C 1, either individually, by working together with a\ngroup of manufacturers, or by working with others, it shall be deemed to meet\nthe convenience requirements of this section.\n\nE. The recovery plan shall include information for the consumer on how and where\nto return the manufacturer&#8217;s computer equipment. The manufacturer:\n\n   1. Shall include collection, recycling, and reuse information on the\n   manufacturer&#8217;s publicly accessible website;\n\n   2. Shall provide collection, recycling, and reuse information to the\n   Department; and\n\n   3. May include collection, recycling, and reuse information in the packaging\n   or in other materials that accompany the manufacturer&#8217;s computer\n   equipment when the equipment is sold.\n\nF. Information about collection, recycling, and reuse on a manufacturer&#8217;s\npublicly accessible website does not constitute a determination by the\nDepartment that the manufacturer&#8217;s recovery plan or actual practices are\nin compliance with this article.\n\nG. If more than one person is a manufacturer of a certain brand of computer\nequipment as defined by &#xA7; 10.1-1425.27, any of those persons may assume\nresponsibility for and satisfy the obligations of a manufacturer under this\narticle for that brand. If none of those persons assumes responsibility or\nsatisfies the obligations of a manufacturer for the computer equipment of that\nbrand, any of those persons may be considered to be the responsible manufacturer\nfor purposes of this article.\n\nH.
