A.<\/span> Third party examiners<\/span> may be certified to conduct skills tests on behalf of only one third party tester<\/span> at any given time. If a third party examiner<\/span> leaves the employ of a third party tester<\/span>, he must be recertified in order<\/span> to conduct skills tests on behalf of a new third party tester<\/span>. <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

B.<\/span> To qualify for certification as a third party examiner<\/span>, an individual must: <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> Make application to the Department<\/span> as provided in § 46.2-341.14:3<\/a> and pass the required nationwide criminal background check; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> Be an employee<\/span> of the third party tester<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> Possess a valid Virginia commercial driver<\/span>’s license with the classification and endorsements<\/span> required for operation of the class and type of commercial motor vehicle<\/span> used in skills tests conducted by the examiner; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

4.<\/span> Satisfactorily complete any third party examiner<\/span> training course required by the Department<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

5.<\/span> Within three years prior to application, have had no driver<\/span>’s license suspensions<\/span>, revocations<\/span>, or disqualifications<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

6.<\/span> At the time of application, have no more than six demerit points on his driving record and not be on probation<\/span> under the Virginia Driver<\/span> Improvement Program; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

7.<\/span> Within three years prior to application, have had no conviction<\/span> for any offense<\/span> listed in § 46.2-341.18<\/a> or 46.2-341.19<\/a>, whether or not such offense<\/span> was committed in a commercial motor vehicle<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

8.<\/span> If the examiner is employed by a school board, be certified by the Virginia Department<\/span> of Education as a school bus<\/span> training instructor<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

9.<\/span> Conduct skills tests on behalf of the third party tester<\/span> in accordance with this article and in accordance with current instructions provided by the Department<\/span>; and <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t
