A retail establishment<\/span> that has an employee toilet facility<\/span> shall allow any customer<\/span> to use such employee toilet facility<\/span> during normal business hours if:<\/p><\/section>\n\t\t\t\t\t\t

1.<\/span> The customer<\/span> does not have immediate access to a public restroom; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

2.<\/span> The employee toilet facility<\/span> is not located in an area where providing access would create an obvious health or safety risk to the customer<\/span> or others or an obvious security risk to the retail establishment<\/span>; <\/i><\/a><\/p><\/section>\n\t\t\t\t\t\t

3.<\/span> The customer<\/span> provides the retail establishment<\/span> with evidence<\/span> of the customer<\/span>’s eligible medical condition<\/span>.
