						<section><p>The <span class="dictionary">Commission</span>&#x2019;s examiners shall make a true report of every examination. The report shall include only <span class="dictionary">facts</span> appearing upon the books, records or other documents of the <span class="dictionary">person</span> examined or as ascertained from the sworn <span class="dictionary">testimony</span> of its directors, officers, employees, agents or other <span class="dictionary">persons</span> examined concerning its affairs and any conclusions and recommendations reasonably warranted from such <span class="dictionary">facts</span>. <span class="dictionary">Findings</span> of <span class="dictionary">fact</span> and conclusions made pursuant to any examination, and reported in any filed examination report for which the period for <span class="dictionary">appeal</span> has expired, shall be prima facie <span class="dictionary">evidence</span> in any subsequent legal or regulatory action.</p></section></text><history>Code 1950, &#xA7;&#xA7; 38-127, 38-216; 1952, c. 317, &#xA7; 38.1-177; 1986, c. 562; 1992, c. 588.</history><metadata></metadata></law>
